Hospital Administrators

Employees of the hospital administration career are definitively placed in health establishments staff lists. The management of the career is a responsibility of ACSS, regardless of hospitals and services under the Ministry of Health where they work. The legal status of the hospital administration career is determined in Decree-Law n. 101/80, of 8 May, as amended by Decree-Law n. 178/87 of 20 April.

This career is regulated for workers with an Employment Contract in Public Functions

The specific tasks of this career are developed in Table II, annexed to Decree-Law n. 101/80, of 8 May, following a tender procedure, on a secondment basis.

Concerning framework, the career is developed by the following categories: 4th grade administrator; 3rd grade administrator; 2nd grade administrator and 1st grade administrator, and the recruitment will operate through the category of 4th grade administrator, under tender documentary procedure, from:

Graduates with a degree in Hospital Administration at the National School of Public Health (Escola Nacional de Saúde Pública)
Graduates with Hospital Administration diplomas obtained in foreign schools, with equivalence through an order of the Minister of Health, under proposal of ACSS, and favourable recommendation of the National School of Public Health (Escola Nacional de Saúde Pública)

Graduates with a degree in Hospital Administration at the National School of Public Health (Escola Nacional de Saúde Pública)

Graduates with Hospital Administration diplomas obtained in foreign schools, with equivalence through an order of the Minister of Health, under proposal of ACSS, and favourable recommendation of the National School of Public Health (Escola Nacional de Saúde Pública)

In order to fill a secondment for places in Table II, it is necessary, for the purpose of the tender procedure, to verify the correspondence between the degree held and the place of hospital administrator desired, as indicated in the table below.

Entrepreneurial Public Sector

Employees recruited by health services and establishments integrated in the entrepreneurial public sector are subject to the labor contract regime, in accordance with the Labour Code, other labour legislation, mandatory guidelines on professional titles, collective labour regulation instruments and internal regulations (Article 14.º of Decree-Law n. 233/2005, of 29 December).

Exception

Article 15 of Decree-Law n. 233/2005, of 29 December, safeguarded the situation of staff with a public employment, integrated in health services / facilities before the change of their legal nature, since they were automatically integrated in the health establishments staff lists of the respective health units.

Additional Information

As far as the hospital administration area is concerned, there is no instrument of collective regulation which standardizes the corresponding career in the field of entrepreneurial public entities. As for the recruitment, only the rules set forth in Article 14 mentioned above should be considered – which must be based on the suitability of professionals for the tasks to be performed and ensure the principles of equal opportunities, impartiality, good faith and non-discrimination, as well as publicity, except in cases of duly authenticated urgency.

Regarding the type of contract, it depends on the nature of the duties to be performed, as well as on the needs to be filled. It is also mandatory to determine, on a case-by-case basis, whether or not such a transaction presumes a special relationship of trust with the respective board of directors, namely if related to the exercise of management duties directly dependent of the administration. Depending on the conclusion reached, it must be celebrated a work contract in the most appropriate regime – for an indefinite period, at the end of the term (certain or uncertain ) or a commission service work contract.
